Actual pricing and schedules depend on scope, design, materials, site conditions, selections, and other factors, and are provided only in a written, signed contract. See our Terms of Service.

5. Hidden & Concealed Conditions

Construction and remodeling of existing structures can reveal conditions that were not visible or reasonably knowable during the estimate or design phase — for example, hidden water or moisture damage, mold, structural deficiencies, outdated or non-compliant wiring or plumbing, asbestos or other hazardous materials, pest damage, or code-compliance issues behind finished surfaces (collectively, “Concealed Conditions”).

  • Estimates and proposals are based on visible and accessible conditions at the time of inspection and do not account for Concealed Conditions.
  • If Concealed Conditions are discovered, the work and cost necessary to address them are not included in the original price and will be handled by written Change Order, which may increase the contract price and extend the schedule.
  • AZA Builders is not responsible for pre-existing conditions, defects in prior work performed by others, or damage arising from such conditions.
6. Third-Party Materials & Manufacturer Warranties

Many components of a project — including appliances, fixtures, cabinetry, countertops, flooring, windows, HVAC equipment, and other manufactured products — are produced by third parties. Such products are covered solely by their respective manufacturer warranties, which we pass through to you. AZA Builders does not manufacture these products and does not independently warrant them. Claims regarding manufactured products must be made under the applicable manufacturer’s warranty. We do not warrant materials or products supplied by the client or selected over our recommendation.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY VIRGINIA LAW, AZA BUILDERS AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOSS OF USE, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE SITE, THE INFORMATION ON IT, OR YOUR RELIANCE ON IT — WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To the fullest extent permitted by law, our total aggregate liability arising from your use of the Site shall not exceed one hundred U.S. dollars (US $100). Liability arising from an actual construction or remodeling project is governed by the limitations set out in your signed contract. Nothing in this section limits liability that cannot be excluded under applicable law.

You agree to indemnify, defend, and hold harmless AZA Builders and its members, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the Site; (b) your violation of these Disclaimers or our Terms of Service; (c) your violation of any applicable law or the rights of any third party; or (d) information you submit through the Site. This provision survives termination of your use of the Site.
