5. Hidden & Concealed Conditions
Construction and remodeling of existing structures can reveal conditions that were not visible or reasonably knowable during the estimate or design phase — for example, hidden water or moisture damage, mold, structural deficiencies, outdated or non-compliant wiring or plumbing, asbestos or other hazardous materials, pest damage, or code-compliance issues behind finished surfaces (collectively, “Concealed Conditions”).
- Estimates and proposals are based on visible and accessible conditions at the time of inspection and do not account for Concealed Conditions.
- If Concealed Conditions are discovered, the work and cost necessary to address them are not included in the original price and will be handled by written Change Order, which may increase the contract price and extend the schedule.
- AZA Builders is not responsible for pre-existing conditions, defects in prior work performed by others, or damage arising from such conditions.
6. Third-Party Materials & Manufacturer Warranties
Many components of a project — including appliances, fixtures, cabinetry, countertops, flooring, windows, HVAC equipment, and other manufactured products — are produced by third parties. Such products are covered solely by their respective manufacturer warranties, which we pass through to you. AZA Builders does not manufacture these products and does not independently warrant them. Claims regarding manufactured products must be made under the applicable manufacturer’s warranty. We do not warrant materials or products supplied by the client or selected over our recommendation.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY VIRGINIA LAW, AZA BUILDERS AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOSS OF USE, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE SITE, THE INFORMATION ON IT, OR YOUR RELIANCE ON IT — WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
